1. Agreement to these terms
These Terms and Conditions govern your access to and use of Automizely, including the website, the application, the pages and content you publish through it, and the APIs. By using the service, you agree to these terms.
2. Service description
Automizely is online software for merchants. It connects business software to shopping carts, marketplaces, REST endpoints, and message providers; automates work between connected systems; creates, sends, tracks, and manages email, SMS, push-notification, advertising, and survey campaigns; manages contacts and segments; publishes landing pages, blog posts, and social posts; and reports on the result. The service is currently offered free of charge unless we publish different terms.
Advertising campaigns do not deliver messages through the service. They create and track a creative and push the selected audience to a platform you have connected, or export it.
3. Accounts and security
You are responsible for maintaining the confidentiality of your login credentials, API tokens, webhook signing secrets, and account activity. You must provide accurate account information and promptly update it when needed.
4. Your data and your recipients
You are responsible for the contact data you upload or import and for the messages you send. You confirm that you have the right to contact the people in your lists, that your sends comply with the marketing, consent, and unsubscribe laws that apply to you, and that the content you publish is lawful and yours to publish. The service records consent and unsubscribe state and applies it to future sends, but it cannot establish consent on your behalf.
5. Acceptable use
You may not use the service to:
- send unsolicited bulk messages, or send to recipients who have not consented or have unsubscribed;
- connect an account, endpoint, or store you do not own or are not authorized to use;
- attempt to bypass rate limits, security controls, or private-network protections;
- upload malicious code or interfere with the availability of the service;
- publish or distribute unlawful, infringing, deceptive, or abusive content.
6. Connected accounts and provider credentials
Campaign sending uses the provider credentials you connect, such as SendGrid, Twilio, or a web-push key. The service acts on your behalf against those accounts, and your use of them stays subject to your agreement with each provider, including their sending policies, quotas, and fees. You are responsible for keeping those credentials valid. We store them encrypted and do not return them to the browser, but a provider outage, suspension, or rejected message is outside our control.
7. Delivery, tracking, and automations
Delivery, open and click tracking, and automation runs depend on network availability, recipient mail and device behaviour, and the third-party systems you connect. Engagement figures and analytics are informational: open tracking in particular is blocked or pre-fetched by many mail clients. Verify important figures before making business decisions on them. Automations act on live systems you have connected, so review a definition before enabling it.
8. Third-party services
The service uses third-party infrastructure and a transactional email provider for account email such as verification and password reset. Data needed to deliver the service may be processed by those providers.
9. Intellectual property
We retain all rights in the service, software, branding, and documentation. You retain rights to your own websites, contacts, campaigns, published content, and account data.
10. Disclaimers and limitation of liability
The service is provided as-is and as-available. To the maximum extent permitted by law, we disclaim implied warranties and are not liable for indirect, incidental, consequential, special, or punitive damages.
11. Changes
We may update these terms as the product changes. If changes are material, we will take reasonable steps to notify users through the service or by email.
